1. WE ARE A MEDICAL EQUIPMENT RETAILER — NOT A HEALTHCARE PROVIDER

1.1 CPAP Medical Equipment Trading Co. LLC is a licensed medical equipment retailer registered in the United Arab Emirates (Trade Licence No. 1436732). We supply CPAP machines, BiPAP devices, sleep therapy masks, accessories, oxygen concentrators, and related equipment to individuals and institutions across the UAE.

1.2 The Company is not a healthcare provider, medical clinic, hospital, diagnostic centre, or licensed medical practice. We do not employ physicians, sleep specialists, pulmonologists, respiratory therapists, or any other licensed clinical professionals in a patient-care capacity.

1.3 Nothing on this Website — including product descriptions, educational content, blog articles, FAQs, social media posts, or any communications from our team — constitutes, or should be construed as, medical advice, clinical guidance, diagnosis, prognosis, or treatment recommendation of any kind.

1.4 The Company's staff may provide general product information, assist with equipment selection based on customer-provided prescription details, and explain device features and specifications. This assistance is informational and administrative in nature only. It does not replace, supplement, or substitute the advice of a qualified healthcare professional.

2. CONSULT YOUR DOCTOR BEFORE PURCHASING OR USING ANY EQUIPMENT

2.1 Sleep apnea, obstructive sleep apnea (OSA), central sleep apnea (CSA), and related respiratory conditions are serious medical conditions that require diagnosis and ongoing management by a qualified and licensed healthcare professional.

2.2 Before purchasing any CPAP machine, BiPAP device, or sleep therapy equipment from the Company, you are strongly advised to:

Obtain a formal diagnosis of your sleep condition from a licensed physician, sleep specialist, or ENT specialist
Obtain a valid, current prescription specifying your required therapy type (CPAP, BiPAP, APAP) and pressure settings from your treating physician
Discuss the suitability of specific equipment models with your physician or sleep therapist prior to purchase
Consult your physician before making any changes to your prescribed therapy settings, mask type, or pressure levels

2.3 The Company will not advise customers on pressure settings, therapy mode adjustments, or clinical therapy management. All such decisions must be made by your treating healthcare professional.

2.4 If you are purchasing equipment for a child, an elderly person, or an individual with complex medical needs, it is especially important that a qualified physician is involved in equipment selection and setup before use.

3. PRESCRIPTION REQUIREMENT

3.1 CPAP and BiPAP therapy devices are prescription medical devices. Their safe and effective use requires a valid prescription issued by a licensed physician or sleep specialist specifying the appropriate therapy type and pressure settings.

3.2 The Company strongly recommends that all customers present a valid prescription when purchasing a CPAP or BiPAP machine. While the Company may, in certain circumstances, supply equipment to customers who confirm they hold a prescription, this does not constitute the Company verifying, validating, or endorsing the prescription or the therapy settings therein.

3.3 The Customer bears sole responsibility for ensuring that the equipment they purchase is appropriate for their prescribed therapy and medical condition, as confirmed by their treating healthcare professional.

3.4 Use of CPAP or BiPAP equipment without a valid prescription, at incorrect pressure settings, or contrary to the instructions of a treating healthcare professional may result in serious adverse health consequences. The Company accepts no liability for any adverse outcomes arising from such use.

4. HOME SLEEP STUDY TEST — LIMITATIONS

4.1 The Company offers the WatchPat One home sleep apnea test as a convenient screening tool for individuals who suspect they may have sleep apnea. This device is used by the Customer independently at home and generates a sleep study report based on recorded physiological data.

4.2 The WatchPat One home sleep test is a screening tool, not a definitive clinical diagnosis. Results generated by this device must be reviewed and interpreted by a licensed physician or sleep specialist before any treatment decisions are made.

4.3 A positive result from a home sleep test does not automatically qualify a customer for CPAP or BiPAP therapy. A negative or inconclusive result does not rule out the presence of a sleep disorder. In all cases, clinical review by a qualified physician is required.

4.4 The Company does not interpret, review, or provide clinical assessment of home sleep test results. The Customer is solely responsible for arranging medical review of their test results with a qualified healthcare professional.

4.5 The Company accepts no liability for any decisions made by the Customer based on home sleep test results that have not been reviewed and validated by a licensed physician.

5. PRODUCT INFORMATION IS NOT CLINICAL GUIDANCE

5.1 Product descriptions, specifications, and feature explanations published on this Website are provided by the Company for informational purposes to assist customers in understanding the products available for purchase. They are based on information provided by manufacturers and are subject to change.

5.2 References to clinical studies, therapy efficacy data, or health outcomes in product descriptions or educational content on this Website are provided for general informational purposes only. They do not constitute medical claims, endorsements, or guarantees of outcome for any individual customer.

6.2 The Company's staff are not qualified to diagnose medical conditions, interpret sleep study results, prescribe therapy settings, or provide clinical advice. Any information shared by Company staff regarding CPAP therapy is provided in their capacity as knowledgeable retail specialists only and should not be relied upon as clinical guidance.

7. REGULATORY STATUS OF EQUIPMENT

7.1 All medical equipment supplied by the Company is sourced from manufacturers whose products are registered and approved for sale in the UAE in accordance with the requirements of the UAE Ministry of Health and Prevention (MOHAP), the Dubai Health Authority (DHA), and, where applicable, UAE Federal Decree-Law No. 38 of 2024 on the Regulation of Medical Products.

7.2 Regulatory approval of a medical device confirms that the device meets required safety and performance standards for its intended use. It does not constitute a recommendation by the Company or any regulatory authority that a particular device is suitable for any specific individual's medical condition.

7.3 The Customer is responsible for ensuring that any equipment purchased complies with the requirements of their treating healthcare provider and relevant health authority, particularly in the case of institutional or hospital purchases.

8. LIMITATION OF LIABILITY

8.1 To the fullest extent permitted by applicable UAE law, the Company shall not be liable for any physical injury, adverse health outcome, medical complication, deterioration in condition, or death arising from:

The Customer's failure to obtain a valid prescription or appropriate medical advice prior to purchasing or using Equipment
The use of Equipment at incorrect, self-prescribed, or unverified pressure settings
The Customer's failure to follow the operating instructions of the manufacturer or the clinical instructions of their treating healthcare professional
Reliance on any general information, product description, or educational content published on this Website as a substitute for individualised medical advice
The use of Equipment in connection with a medical condition that has not been formally diagnosed by a licensed physician
Continued use of Equipment where the Customer has been advised by a healthcare professional to discontinue therapy

8.2 Nothing in this Disclaimer limits or excludes any rights the Customer may have under applicable UAE consumer protection or health law that cannot be excluded by agreement.

8.3 This Disclaimer does not affect the Company's obligations under its Refund and Returns Policy, Warranty Policy, or Terms and Conditions with respect to the quality and condition of Equipment supplied.

9. EMERGENCY SITUATIONS

9.1 If you are experiencing a medical emergency, a severe adverse reaction, significant breathing difficulty, chest pain, or any other acute health concern, do not contact the Company. Call emergency services immediately by dialling 998 (UAE Ambulance) or 999 (UAE Police/Emergency).

9.2 This Website and the Company's communications channels are not monitored for medical emergencies and are not a substitute for emergency medical services.
