Product & Trademark Disclosure Policy

1. PURPOSE AND SCOPE

1.1 This Product and Trademark Disclosure Policy ("Policy") is issued by CPAP Medical Equipment Trading Co. LLC (Trade Licence No. 1436732), trading as CPAP Medical Trading (hereinafter "the Company," "we," "us," or "our"), a company registered and operating under the laws of the United Arab Emirates with its principal place of business at Tamani Arts Building, Office 1739, Al Asayel Street, Business Bay, Dubai, UAE.

1.2 This Policy sets out the Company's position with respect to the intellectual property rights, trademarks, registered trade names, brand names, product names, and proprietary designations of third-party manufacturers and brand owners whose products the Company retails or references on its Website at www.cpapmedtrade.com and in its physical showroom.

1.3 This Policy is intended to provide full transparency to customers, manufacturers, brand owners, and regulatory authorities regarding the nature of the Company's retail activities, its relationship to the brands it carries, and its absolute commitment to supplying only new, genuine, and unused medical equipment through lawful and ethical commercial channels.

1.4 This Policy is issued in compliance with and by reference to the following applicable legal frameworks:

2. TRADEMARK OWNERSHIP — ALL RIGHTS RESERVED TO RESPECTIVE OWNERS

2.1 All product names, brand names, trade names, model designations, registered trademarks, service marks, trade dress, logos, and proprietary identifiers referenced, displayed, or used on this Website or in any Company communications are the exclusive intellectual property of their respective owners and originating manufacturers. The Company makes no claim of ownership, co-ownership, or proprietary interest in any third-party trademark, registered mark, or brand name whatsoever.

2.2 The brand names, product names, model designations, and associated trademarks referenced on this Website include those belonging to the manufacturers and brand owners whose products the Company retails. All such marks are the exclusive intellectual property of their respective owners. These brand names and product designations are referenced solely for the purpose of accurately identifying the products the Company supplies, informing customers of product specifications and compatibility, and facilitating legitimate retail commerce. No claim of ownership, affiliation, agency, sponsorship, or endorsement is made by the Company in respect of any such mark.

2.3 The use of any third-party trademark on this Website constitutes nominative fair use under applicable intellectual property law, including the principles established under the TRIPS Agreement and UAE Federal Decree-Law No. 36 of 2021 on Trademarks. 3. NATURE OF THE COMPANY'S RETAIL ACTIVITIES

3.1 CPAP Medical Trading operates as an independent medical equipment retailer. The Company sources CPAP machines, BiPAP devices, sleep therapy masks, accessories, consumables, and related equipment through legitimate commercial supply channels, including authorised distributors, licensed wholesalers, and direct commercial arrangements operating lawfully within applicable UAE regulations.

3.2 The Company is not the exclusive agent, sole distributor, or official brand representative of any manufacturer in the UAE, unless expressly and separately confirmed in writing. The absence of an exclusive agency or distribution agreement does not affect the legitimacy, authenticity, or quality of the products the Company supplies.

3.3 The Company supplies only brand-new, unused, genuine medical equipment in its original manufacturer packaging. The Company does not sell, stock, distribute, trade in, or deal with used equipment, pre-owned devices, returned units, or any product that has previously been in the possession of another end user in any capacity. Every product sold by the Company is supplied in new, sealed condition directly as received from the supply chain.

3.4 The Company does not sell, stock, or knowingly source counterfeit, imitation, non-genuine, or fraudulently represented products of any kind. All reasonable commercial due diligence is conducted when engaging suppliers to verify product authenticity, regulatory compliance, and chain of custody.

3.5 Where products are sourced through parallel import channels — that is, brand-new, genuine, unused products imported and sold lawfully outside the manufacturer's official UAE distribution network — the Company advises customers that in such cases the manufacturer's local warranty support in the UAE may differ from that offered on products purchased through the official UAE distribution channel. The Company's own obligations with respect to defect identification and exchange, as set out in its Warranty Policy at www.cpapmedtrade.com/pages/warranty-policy, remain fully applicable in all cases regardless of the supply channel through which the product was sourced.

4. PRODUCT AUTHENTICITY COMMITMENT

4.1 The Company makes the following unequivocal commitments to its customers, healthcare partners, and regulatory authorities:

Every product sold by CPAP Medical Trading is brand-new and unused at the point of sale
Every product is genuine and original — manufactured by the brand owner whose name it bears
Every product is supplied in its original manufacturer packaging with all included accessories and documentation intact
The Company does not deal in used, pre-owned, previously returned, or second-hand medical equipment under any circumstances
The Company does not deal in counterfeit, imitation, replica, or non-genuine products under any circumstances
The Company does not misrepresent the condition, origin, or authenticity of any product it sells

4.2 These commitments are absolute and unconditional. They apply to every product the Company sells, regardless of brand, price point, supply channel, or any other factor.

The Company will investigate all such concerns without delay and will take full remedial action where any deviation from these commitments is established.

5. NO AFFILIATION OR ENDORSEMENT

5.1 CPAP Medical Trading is an independent commercial entity. It is not affiliated with, owned by, operated by, or acting as an agent of any manufacturer or brand owner whose products it retails. The Company's use of brand names, product names, and model designations on this Website is strictly for product identification and informational purposes.

5.2 No manufacturer or brand owner referenced on this Website has endorsed, sponsored, approved, or reviewed the content of this Website or the Company's commercial activities, unless expressly stated in writing. The Company does not represent itself as having any endorsement, approval, or commercial backing from any manufacturer beyond what is reflected in any formal written commercial agreement between the parties.

The Company endeavours to ensure accuracy and currency of all product information; however, manufacturers may update, modify, discontinue, or revise their products, specifications, or packaging at any time without prior notice to the Company or its customers.

All manufacturer-supplied images remain the intellectual property of the respective manufacturer. 7.2 No person, entity, competitor, or third party may reproduce, copy, adapt, distribute, publish, broadcast, or commercially exploit any original content or intellectual property of the Company without prior express written authorisation from the Company's management.

7.3 The trade name "CPAP Medical Trading" and the registered company name "CPAP Medical Equipment Trading Co. LLC" are exclusively owned by and registered to the Company under UAE commercial registration laws, as evidenced by Trade Licence No. 1436732 issued by the relevant UAE licensing authority. These names are the sole and exclusive property of the Company and may not be used, adopted, imitated, abbreviated, or incorporated into any other trading name, company name, domain name, social media handle, or commercial identifier by any third party without the prior express written consent of the Company. Any unauthorised use of these names or any confusingly similar variation thereof constitutes an infringement of the Company's registered commercial identity and rights under UAE law and will be subject to immediate legal action.

8. REGULATORY COMPLIANCE — MEDICAL DEVICES

8.1 The Company operates in compliance with applicable UAE medical device regulations. All products supplied by the Company are intended for use as medical devices and are sourced in accordance with the regulatory framework established by:
